1. ACCEPTANCE OF THESE TERMS

Welcome to the Bunk-a-Biker application, website, and related services (collectively, the "Service").

The Service is a social and community platform designed for motorcyclists, motorcycle travelers, riders, and members of the broader motorcycle community.

By accessing, downloading, installing, registering for, or using the Service, you agree to these Terms of Use and End User License Agreement ("Terms").

If you do not agree to these Terms, do not access, install, register for, or use the Service.

These Terms constitute a legally binding agreement governing your use of the Service.

2. PURPOSE OF THE SERVICE

The Service is intended to provide a social and community environment for motorcyclists and motorcycle travelers.

The Service may provide, among other things:

• Social networking and community features;
• Rider-to-rider communication;
• Rooms, groups, spaces, and community areas;
• Motorcycle-related information and resources;
• Travel and rider resources;
• Maps and location-related information;
• Tools and utilities for riders;
• Information concerning places, services, events, routes, accommodations, and motorcycle-related activities; and
• Other features developed or provided for the benefit of the riding community.

Features and functionality may be added, modified, suspended, or discontinued at any time.

3. YOUR LICENSE TO USE THE SERVICE

Subject to your compliance with these Terms, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for its intended purposes.

Your license permits you to use the application, website, tools, features, information, and community services made available to you.

You are being granted permission to use the Service. You are not being sold or given ownership of the Service or its underlying software, technology, databases, or intellectual property.

Your license automatically terminates when your account is terminated, your access is revoked, or the Service is discontinued, except for any rights that by their nature survive termination.

4. SOFTWARE OWNERSHIP

The software underlying the Service, including its source code, object code, application architecture, user interface, design, workflows, functionality, graphics, original materials, documentation, and other proprietary technology, is protected by applicable intellectual property laws.

Nothing in these Terms transfers ownership of the software to you.

You may not copy, reproduce, distribute, sell, license, publish, modify, reverse engineer, decompile, disassemble, or create derivative works from proprietary portions of the Service.

5. DATA AND DATABASE OWNERSHIP

Certain data, databases, directories, listings, community resources, informational collections, and other information made available through the Service are owned by or provided under the authority of:

Access to this information through the Service does not transfer ownership of that information to you.

You may access and use this information as part of your ordinary use of the Service.

You may not systematically copy, scrape, harvest, extract, reproduce, republish, redistribute, sell, license, or commercially exploit the Service's databases or substantial portions thereof without express written authorization.

The compilation, organization, selection, arrangement, and presentation of data may itself constitute protected intellectual property, even where individual facts or pieces of information may not independently be protected by copyright.

6. PROHIBITED USE

You agree not to use the Service, directly or indirectly, to:

1. Copy or reproduce the software or proprietary portions of the Service;
2. Reverse engineer, decompile, disassemble, or attempt to obtain source code;
3. Modify, alter, adapt, or create derivative works from the software;
4. Circumvent security measures or technical limitations;
5. Attempt to gain unauthorized access to accounts, servers, systems, or databases;
6. Scrape, crawl, spider, harvest, or systematically collect information;
7. Use bots, automated scripts, crawlers, data-mining tools, or similar technologies without express authorization;
8. Download or extract substantial portions of the Service's databases;
9. Create a competing database, directory, website, application, or service using information obtained from the Service;
10. Sell, rent, lease, sublicense, transfer, or commercially redistribute access to the Service;
11. Remove copyright, trademark, attribution, licensing, or proprietary notices;
12. Interfere with the operation, security, or availability of the Service;
13. Introduce malicious code, malware, viruses, or other harmful technology;
14. Use another person's account without authorization;
15. Impersonate another person, organization, business, or community member;
16. Use the Service for unlawful purposes; or
17. Engage in conduct that materially interferes with the legitimate use of the Service by other users.

Unauthorized access, copying, extraction, distribution, or use may constitute a violation of applicable civil or criminal law in addition to violating these Terms.

7. COMMUNITY USE AND CONDUCT

The Service exists to facilitate communication, interaction, information sharing, and community among motorcycle riders and travelers.

Users may participate in rooms, groups, spaces, discussions, messaging, reviews, listings, events, and other community features.

You are responsible for your own conduct and interactions with other users.

You agree not to use the Service to:

• Harass, threaten, stalk, or intimidate another person;
• Publish knowingly false or fraudulent information;
• Distribute illegal or harmful material;
• Infringe another person's intellectual-property rights;
• Violate another person's privacy;
• Facilitate criminal activity;
• Spam or abuse communication features;
• Conduct unauthorized commercial solicitation;
• Impersonate another person;
• Create accounts for deceptive or abusive purposes; or
• Otherwise misuse the community.

The operators of the Service reserve the right, but do not assume an obligation, to remove content, restrict access, suspend accounts, or terminate accounts that violate these Terms or create a risk to the Service or its users.

8. USER CONTENT

The Service may allow you to submit, upload, post, transmit, or otherwise provide content, including photographs, text, reviews, comments, messages, recommendations, locations, descriptions, and other material ("User Content").

You retain ownership of User Content that you independently own.

By submitting User Content to the Service, you grant the operators of the Service a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, distribute, format, and otherwise use that content as reasonably necessary to operate, maintain, administer, improve, and provide the Service.

This license does not transfer ownership of your User Content to the Service operators.

You represent that:

1. You have the right to submit the User Content;
2. Your submission does not knowingly violate another person's rights;
3. You are not knowingly submitting unlawful material; and
4. The information you provide is not intentionally fraudulent or deceptive.

You remain responsible for the content you submit.

9. MOTORCYCLE, TRAVEL, MAP, AND LOCATION INFORMATION

The Service may provide information relating to motorcycles, roads, routes, locations, accommodations, rider services, businesses, events, travel destinations, hazards, recommendations, maps, and other travel-related information.

Such information is provided for informational and community purposes only.

Conditions can change.

Roads may be closed. Routes may be unsafe. Businesses may move or close. Locations may become unavailable. Weather and traffic conditions may change. User-submitted information may be incorrect or outdated.

You are solely responsible for determining whether a route, destination, road, location, accommodation, business, or activity is appropriate and safe for you.

Do not rely exclusively on this Service for navigation, emergency information, road conditions, or safety-critical decisions.

When riding a motorcycle, you are responsible for operating your motorcycle safely and in compliance with applicable laws.

10. MOTORCYCLING AND PERSONAL SAFETY

MOTORCYCLING INVOLVES INHERENT RISKS, INCLUDING SERIOUS INJURY AND DEATH.

The Service is not a substitute for your own judgment, training, preparation, navigation, safety equipment, weather assessment, motorcycle maintenance, mechanical inspection, or compliance with applicable laws.

Information provided by other riders or users represents their experiences or opinions and does not constitute a guarantee of safety.

You are solely responsible for your decisions and actions while riding or traveling.

11. NO GUARANTEE OF INFORMATION ACCURACY

The Service may contain information supplied by users, businesses, third parties, automated systems, public sources, or other contributors.

We do not guarantee that information provided through the Service is:

• Accurate;
• Complete;
• Current;
• Reliable;
• Available;
• Suitable for a particular purpose; or
• Free from errors or omissions.

You should independently verify important information before relying upon it.

12. THIRD-PARTY SERVICES AND CONTENT

The Service may contain links to, integrations with, references to, or information concerning third-party websites, businesses, services, applications, accommodations, products, events, or other resources.

Third-party services are not necessarily owned or controlled by the operators of this Service.

We are not responsible for the availability, accuracy, security, policies, practices, products, services, or conduct of third parties.

Your dealings with third parties are solely between you and the applicable third party.

13. OPEN-SOURCE AND THIRD-PARTY SOFTWARE

Certain components of the Service may incorporate open-source software, mapping technology, libraries, frameworks, APIs, or other third-party components.

Those components may be subject to separate licenses.

Where required, applicable copyright notices, attribution, and licensing information are provided within the Service or accompanying documentation.

Nothing in these Terms is intended to restrict rights granted to you under an applicable open-source license.

Third-party components remain subject to their respective licenses and ownership rights.

14. INTELLECTUAL PROPERTY

All trademarks, service marks, logos, names, designs, graphics, software, databases, original content, and other intellectual property associated with the Service belong to their respective owners.

Nothing in these Terms grants you any ownership interest in such intellectual property.

All rights not expressly granted to you are reserved.

Unauthorized reproduction, distribution, extraction, modification, reverse engineering, or commercial exploitation may constitute infringement and may subject the responsible party to legal action.

15. SERVICE AVAILABILITY

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

We do not guarantee that the Service will:

• Be continuously available;
• Operate without interruption;
• Be free from errors;
• Be free from security vulnerabilities;
• Remain available indefinitely;
• Remain compatible with every device or operating system;
• Preserve every feature; or
• Preserve every item of information indefinitely.

The Service may be modified, updated, suspended, restricted, or discontinued at any time.

16. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, SOFTWARE, DATA, INFORMATION, CONTENT, MAPS, TOOLS, AND OTHER MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND RELIABILITY, ARE DISCLAIMED.

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVERIFIC, TOM BLIZZARD, ZEE TRAVELER, BUNK-A-BIKER, AND THEIR RESPECTIVE OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES OR LOSSES ARISING FROM:

• Information provided through the Service;
• User-generated content;
• Maps or routes;
• Road or weather conditions;
• Travel or riding activities;
• Third-party businesses or services;
• Accommodations or locations;
• Service interruptions;
• Loss of data;
• Account loss;
• Unauthorized access; or
• Reliance upon information provided through the Service.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

18. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Serverific, Tom Blizzard, Zee Traveler, Bunk-a-Biker, and their respective owners, members, managers, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• Your violation of these Terms;
• Your misuse of the Service;
• Your User Content;
• Your violation of another person's rights;
• Your violation of applicable law; or
• Your conduct in connection with the Service.

19. ACCOUNT SUSPENSION OR TERMINATION

We may suspend or terminate your account or access to the Service if you violate these Terms, misuse the Service, engage in conduct that threatens the Service or its users, or for other legitimate operational, legal, or security reasons.

Upon termination, your license to use the Service immediately ends.

You must cease all unauthorized use of the Service and its proprietary materials.

Provisions concerning intellectual property, restrictions, disclaimers, limitations of liability, indemnification, and other provisions that by their nature should survive termination shall remain in effect.

20. CHANGES TO THE SERVICE OR THESE TERMS

The Service may change over time.

Features may be added, removed, modified, replaced, or discontinued.

These Terms may also be updated from time to time.

When appropriate, notice of material changes may be provided through the Service or other reasonable means.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

21. GOVERNING LAW AND VENUE

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict-of-law rules.

To the extent permitted by applicable law, any dispute, claim, or legal proceeding arising out of or relating to these Terms, the Service, the software, or your use of the Service shall be brought in the state or federal courts located in Tennessee, and you consent to the jurisdiction and venue of those courts.

Nothing in this section is intended to waive, restrict, or limit any rights or protections that cannot lawfully be waived under applicable law, including any mandatory consumer protections applicable to you based upon your place of residence.

22. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

23. NO WAIVER

Failure to enforce any provision of these Terms shall not constitute a waiver of the right to enforce that provision in the future.

24. ENTIRE AGREEMENT

These Terms constitute the agreement governing your use of the Service with respect to the matters addressed herein, together with any additional terms expressly incorporated into the Service.

25. RESERVATION OF RIGHTS

You are receiving a limited license to use the Service. You are not purchasing the software.

You do not receive ownership of:

• The application;
• The website;
• The underlying software;
• The source code;
• The application architecture;
• The proprietary databases;
• The database structure;
• Proprietary tools or functionality;
• Trademarks or logos; or
• Other intellectual property belonging to the Service or its respective owners.

All rights not expressly granted to you are reserved.

Unauthorized copying, scraping, extraction, reverse engineering, redistribution, commercial exploitation, or other use outside the license granted by these Terms is expressly prohibited.
